1 – Definitions
“Services” – the MyDataXport web and mobile applications.
“Content” – data you upload, transfer, or store via the Services.
“We/our/us” – MyDataXport Limited.
“You/your” – the person or entity using the Services.
2 – Acceptance
By creating an account, selecting “I agree,” or using the Services, you accept these Terms and our Privacy Policy.
3 – The Service
We connect to your MYOB Business Plus/Pro file and copy selected data to a folder (/MyDataXport/{Organisation}/{YYYY-MM-DD}) in your connected Google Drive, OneDrive, or Dropbox account.
4 – Account responsibilities
You must be 18 or older, provide accurate information, and keep credentials secure. You are responsible for all activity under your account.
5 – Fees, Billing & Renewal
1. Annual plan – The Service is sold as a 12-month subscription, paid up-front in NZ dollars through Stripe (or another processor we nominate).
2. No mid-term refunds – Cancelling before the end of the current 12-month term does not entitle you to a refund; the Service remains available until the term expires.
3. Automatic renewal – Unless you disable renewal at least 24 hours before the anniversary date, your subscription auto-renews for another 12 months at the then-current price, charged to your saved payment method.
4. Price changes – We’ll email you at least 30 days before any price increase, which will apply at the next renewal.
5. Taxes – Prices include GST where applicable (NZ or AU).
(Nothing in this section limits statutory remedies under the New Zealand Consumer Guarantees Act 1993 or Australian Consumer Law.)
6 – Intellectual property
We own the platform, software, and branding. You own your Content. You grant us a limited licence to handle it solely to provide the Services.
7 – Acceptable use
No unlawful, infringing, or abusive activity; no reverse-engineering or attempts to access other users’ data.
8 – Third-party services
Your use of MYOB, Google Drive, OneDrive, and Dropbox is governed by their own terms. We are not responsible for their uptime or data loss.
9 – Data handling & deletion
We purge backup payloads immediately after successful upload to cloud storage. On written request we’ll delete residual logs and tokens, except those we must keep for tax or legal reasons.
10 – Disclaimer of warranties
The Services are provided “as is” and “as available.” We make no warranties that backups, cloud services, or MYOB APIs will be uninterrupted, timely, or error-free.
11 – Limitation of liability
To the fullest extent permitted by law, our total liability to you in any 12-month period is capped at the fees you paid us in that period.
12 – Indemnity
You agree to indemnify and hold us harmless from claims arising out of your misuse of the Services or breach of these Terms.
13 – Suspension & termination
• You may cancel anytime via the dashboard or support email. Cancelling stops future renewals but does not refund the current term (§ 5).
• We may suspend or terminate for material breach, non-payment, or legal requirement.
14 – Modifications
We may update the Services or these Terms; material changes to Terms will be notified 30 days in advance. Continued use after that date constitutes acceptance.
15 – Dispute resolution
Contact [email protected] within 30 days of an issue. If unresolved, disputes are subject to the exclusive jurisdiction of the New Zealand courts.
16 – Force majeure
Neither party is liable for failure to perform due to events beyond reasonable control (e.g. natural disasters, internet outages).
17 – Assignment
We may assign these Terms as part of a merger, acquisition, or asset sale. You may not assign without our written consent.
